Important Information for Subcontractors
Construction managers are often hired by building owners to keep project running smoothly, on time, and under budget. Although the scope of work for a CM can vary, they are almost always charged with scheduling the work of trade contractors so that everyone can do their jobs properly.

Many of the lawsuits that Douglas E Barnhart has been involved in have involved trade contractors. One subcontractor who worked with Douglas E Barnhart on the Millsworth Middle School in Lodi filed a cross-complaint against Barnhart in Sacramento Superior Court. The complained alleged that Barnhart failed to properly supervise the project and manage the construction schedule. The mechanical contractor who filed the cross-complaint against Barnhart alleged that Barnhart failed to supply enough workers, failed to supply proper materials, failed to properly oversee the nature, scope, and schedule of the project. This case is still pending before the Superior Court, and the outcome is unknown.

One subcontractor, R&R Controls, filed a complaint (San Diego Superior Court case #GIC841248) against Douglas E Barnhart and other parties for failing to pay for work performed in the Temecula Valley Unified School District. According to the complaint, Douglas E Barnhart was the construction manager for the project, and was responsible for overseeing the work of the trades and distributing funds received from the district to the trades. R&R Controls did not receive the full amount that was due to them for installing HVAC control systems. This case was resolved out of court, but the subcontractor had to file a suit to get the money that was due for work performed.

According to complaints filed with the California Department of General Services, from 2002 to 2004 Douglas E Barnhart failed to pay many subcontractors that worked for Barnhart on a government project in Riverside County. All together, the complaints by subcontractors totaled $273,230.
