Chula
Vista Library
The city of Chula Vista hired Douglas E Barnhart to build
the South Chula Vista Library. Construction on the project
was completed in 1995. Since then, serious construction defects
have appeared. The library has suffered:
• moisture underneath the carpeting,
• leaks in the roof,
• leaks in three fountains,
• soil subsidence,
• cracks in the tile flooring.
The City of Chula Vista sued Douglas E Barnhart in San Diego
Superior Court (Case #: GIC817358), asking for $550,000 in
damages. The City eventually received $450,000 in a settlement
reached with Douglas E. Barnhart, according to the San Diego
Union-Tribune (12/16/2004).

Morada Condominium Project
Douglas E Barnhart was the general contractor for the Morada
Condominium Project in San Diego County. Douglas E Barnhart
built 338 condos that were eventually sold to individual investors.
In 2002, the homeowners’ association for the Morada
Condominiums issued a Notice to Builder to the previous owner
of the building, making a claim for defects in the design
and/or construction of the project. The previous owners then sued Douglas E Barnhart, and in 2005 a jury found that Douglas E Barnhart was responsible for $387,000 in damages and its subcontractor, Sahara Waterproofing, was responsible for $918,000 in damages to the deck and balcony of the building.

Saddleback Valley Unified School District
Saddleback Valley Unified School District hired Douglas E
Barnhart as a general contractor to make improvements to Portola
Hills Elementary School. In a lawsuit filed in Orange County
Superior Court (Case #: 02CC17784), the school district alleged
that Barnhart and other contractors working on the project
failed to discover and remediate adverse soil conditions.
As a result, Portola Hills Elementary School suffered damage,
and the school district had to find alternate classroom facilities
while the defects were repaired. The complaints against DEB
were dismissed pursuant to an out-of-court settlement.
